Tax residency rule, United Arab Emirates

UAE Tax Residence — 183 Days

Summary

You are a tax resident of the United Arab Emirates when you are physically present in the country for 183 days or more within 12 consecutive months. Any part of a day counts as a day, and the days do not need to be in a row. For most people this is a goal and not a limit: reaching it lets you ask the Federal Tax Authority for a Tax Residency Certificate. The rule is in article 4 of Cabinet Decision 85 of 2022, in force since 1 March 2023. It needs no visa, home or job in the UAE.

Who it applies to

The rule

Cabinet Decision 85 of 2022 on Determination of Tax Residency gave the UAE its own written definition of a tax resident. It came into effect on 1 March 2023. Article 4 says a natural person is a tax resident in the UAE when any one of three conditions is met.

The first condition: your usual or primary place of residence and the centre of your financial and personal interests are in the UAE. The second condition, which this tracker follows: you have been physically present in the UAE for a period of 183 days or more, within the relevant 12 consecutive months. The third condition is a shorter route of 90 days for some people, with its own tracker, UAE Tax Residence — 90 Days.

Ministerial Decision 27 of 2023 explains the counting. A day means a calendar day. All days or parts of a day on which you are physically present in the UAE count towards the total. The days do not need to be consecutive. The 183 days are measured inside a relevant period of 12 consecutive months, not inside the calendar year.

Article 5 of the Cabinet Decision says a person who is a tax resident may apply to the Federal Tax Authority for a Tax Residency Certificate, and the Authority may issue it when it is satisfied that the conditions are met. Article 6 adds that when a tax treaty sets its own conditions for residence, those conditions apply for that treaty.

Why it exists

For many years the UAE had no general definition of tax residence in its own law, and people relied on certificates issued under separate rules. With the new federal corporate tax and many tax treaties, the state needed one clear definition. The 183-day test gives a simple answer that other countries understand, and it gives people who live in the UAE a way to prove it.

Counting the days

You count every calendar day on which you were physically in the UAE, for all or part of the day, inside 12 consecutive months.

  1. Get your UAE entry and exit record. The immigration authorities can give a travel report with every crossing.
  2. Choose the 12 consecutive months you want to prove, for example the 12 months that end today.
  3. Count every day with any time in the UAE, including the days you arrived and the days you left.
  4. Add the days of all stays inside the 12 months.
  5. If the total is 183 or more, the condition is met.
  6. If you need a Tax Residency Certificate, apply to the Federal Tax Authority with the travel report and the other documents it asks for.
How Countr counts it. Countr treats this rule as a goal, not a limit. It counts every day on which you were in the UAE for any part of the day, over the 12 months that end today, and shows your progress towards 183 days. This is the same way that Ministerial Decision 27 of 2023 counts. The rule accepts any 12 months in a row, and the card shows the last 12 months, so a period that ended earlier can already qualify. If you are a UAE resident with a home or a job in the country, 90 days can be enough: add the UAE Tax Residence — 90 Days rule for that route. Countr does not issue or replace the certificate, and a certificate for use under a tax treaty is a separate application.

Examples

Reaching 183 days

Elena moves to Dubai on 1 September 2025 and stays until 2 March 2026. She counts 30 days in September, 31 in October, 30 in November, 31 in December, 31 in January, 28 in February and 2 in March. The total is 183 days inside 12 consecutive months. On 2 March 2026 she meets the condition and can apply for a Tax Residency Certificate.

One day short

Victor has a UAE residence visa but travels for work most of the time. In the 12 months to 30 June 2026 he is in the UAE for 182 days. He does not meet the 183-day condition for that period. He needs one more day in the UAE inside those 12 months, or he must use another condition, such as the 90-day route if he has a permanent home or a job in the UAE.

A late landing counts

Nadia lands in Abu Dhabi at 23:40 on 14 May and flies out at 01:15 on 20 May. Parts of a day count as days, so she counts 14, 15, 16, 17, 18, 19 and 20 May, which is 7 days, although she was in the country for less than six full days of 24 hours.

Exceptions

Common misconceptions

“A UAE residence visa makes me a UAE tax resident.”
No. The visa is an immigration document. Tax residence comes from one of the three conditions in article 4, and the 183-day condition is about days of physical presence.
“I need a visa or a home in the UAE for the 183-day test.”
The 183-day condition has no such requirement in the Cabinet Decision. It asks only for physical presence. The visa, home and job conditions belong to the 90-day route.
“The 183 days must fall in one calendar year.”
The law says within the relevant 12 consecutive months. The period can start in any month.
“With a UAE Tax Residency Certificate, my old country can no longer tax me.”
The certificate proves UAE residence under UAE rules. Your old country applies its own law, and a tax treaty may use its own definition of residence. The other tax authority looks at your whole situation.

Questions and answers

Do the days I arrive in and leave the UAE count?

Yes. Ministerial Decision 27 of 2023 says that all days or parts of a day on which you are physically present in the UAE count towards the total.

Do the 183 days need to be in a row?

No. The days do not need to be consecutive. Every day in the UAE inside the same 12 consecutive months is added.

Do transit stops in Dubai count as days in the UAE?

The decisions count days on which you are physically present in the State and give no separate rule for transit. If you enter the country, the day counts. Countr counts a day when it can see that you were in the UAE.

How do I get a UAE Tax Residency Certificate?

You apply to the Federal Tax Authority in the form it sets, after you meet one of the conditions. The Authority issues the certificate when it is satisfied that the conditions are met.

Does the UAE tax my salary when I become a tax resident?

The UAE does not charge personal income tax on salaries. Tax residence matters mainly for certificates, for tax treaties and for the federal taxes that the Federal Tax Authority runs.

Can I be a UAE tax resident with only 90 days?

Yes, if you are a UAE national, hold a valid UAE residence permit or are a national of a Gulf Cooperation Council state, and you have a permanent place of residence in the UAE or carry on a job or business there.
