Legal
Terms of use
The agreement for using Countr. The most important point first: Countr helps you keep a record and count days. It does not give legal, tax or immigration advice.
Effective: 30 September 2026. Last updated: 1 October 2026.
These Terms of Use ("Terms") form a legally binding agreement between you and FABERA YAZILIM HİZMETLERİ ANONİM ŞİRKETİ ("Fabera", "we", "us", or "our") regarding your access to and use of the Countr mobile application, its widgets, this website, subscriptions and related services (together, the "Service"). Our registered address and contact details are in Section 20.
By downloading, accessing, purchasing or using the Service, you confirm that you have read, understood and agreed to these Terms. Our Privacy Policy is a notice describing how personal data is processed; it is not part of these Terms and reading it is not consent to data processing. If you do not agree to these Terms, do not use the Service.
1. Eligibility and legal capacity
You must be at least 16 years old and not be prohibited from using the Service under applicable law. If you are under 18 or have not reached the age of legal majority where you live, you may use Countr only with the permission of a parent or legal guardian, who must review and agree to these Terms on your behalf and approve any purchases.
You are responsible for ensuring that your use of the Service is lawful where you are. We may restrict availability by territory, device, operating-system version, language or other legitimate operational or legal criteria.
2. What Countr provides
Countr builds a record of the days you spend in countries and regions from the photo and video metadata, device location data and manual entries you choose to provide, and calculates day counts against trackers you select, such as visa stay limits, tax-residence day thresholds, and residence or citizenship presence requirements. It can also fill gaps between known days according to settings you choose, schedule local reminders, show widgets, store travel proofs, and export reports. Features may be free, subscription-only, unavailable in some regions, or changed over time.
Countr processes your travel record on your device. Fabera does not receive, store or back up your travel record, and cannot restore it for you.
3. No legal, tax or immigration advice
All trackers, day counts, limit dates, reminders, rule descriptions, guides, calculators and other content are provided for general information and record-keeping only. Nothing in the Service is, or should be understood as:
- legal, tax, immigration, accounting or other professional advice;
- a determination of your tax residence, visa status, right of entry or stay, eligibility for residence or citizenship, or any other legal status;
- an assurance that a border officer, tax authority, immigration office or court will reach the same count, date or conclusion; or
- the establishment of an advisory, fiduciary, agency or other professional relationship.
Legal outcomes often depend on facts the app cannot know, such as your nationality, visa or permit type, bilateral agreements, your home, family, employment, ties, treaty tie-breaker rules, exceptional circumstances, and the discretion of the authority. You must verify requirements with the competent official authority and obtain advice from a qualified professional before relying on any result.
4. Your travel record and its accuracy
The accuracy of your record depends on its sources, and each source can be wrong or incomplete:
- Photo and video metadata may be missing, altered, set by another device or app, recorded with an incorrect clock or time zone, or captured on a device other than yours.
- Device location may be unavailable, delayed, imprecise, or affected by permissions, battery settings, airplane mode, network conditions or operating-system behaviour. Places near borders, at sea, in the air or in transit may be assigned to the wrong country or region.
- Days filled by the app ("Auto-filled") are estimates based on your last known location and your gap settings. They are not evidence of where you were.
- Border days and time zones. Different rules count arrival days, departure days, partial days or midnights differently. The app applies the convention modelled for each tracker, which may not match every authority's practice.
You are responsible for reviewing your record, correcting it, and keeping original evidence such as tickets, boarding passes, entry and exit stamps and receipts. Exports and travel proofs are convenient summaries and copies; they do not replace original documents, and you are responsible for what you store in the app and to whom you send an export.
Your travel record is stored only on your device. It can be lost if the app or its data is deleted, the device is lost or fails, or storage is corrupted. You are responsible for your own device backups and for exporting anything important.
5. Trackers and rule data
Each tracker is a simplified model of the day-count element of a rule, prepared by Fabera from the official source named in the app. Rules change, have exceptions, are interpreted differently in practice, and may apply differently to you. A tracker may be incomplete, out of date, or not reflect a recent change, transitional provision or your personal situation, including between the date a rule changes and the date the app is updated. Custom trackers you create are your own configuration, and you are responsible for their parameters.
We may add, correct, update, merge or remove trackers at any time. We do not promise that any tracker, country, region or rule will remain available.
6. Your decisions
All decisions about travel, entry, stay, residence, tax filings and applications are yours alone and are made at your own risk. Reminders are a convenience only: a reminder that is late, not delivered, disabled or based on incomplete data does not change any legal limit or deadline. Fabera has no duty to monitor your travel, update you about changes in law, or warn you of every rule relevant to your situation.
7. Subscriptions, free trials, billing, cancellation and refunds
Certain features require an auto-renewing subscription purchased through Apple's App Store (on iPhone) or Google Play (on Android), each a "Store". The product, trial eligibility, trial duration, billing period, price, currency, renewal terms and included features shown on the purchase screen when you subscribe form part of these Terms. Storefront prices are supplied by the Store and may vary by country, currency, tax and pricing tier.
If the Store confirms that you are eligible for a free trial, you will not be charged during the stated trial period. Unless you cancel at least 24 hours before the trial or current period ends, your subscription automatically converts to the displayed paid plan or renews for the same period, and continues to renew until cancelled. The Store charges the payment method associated with your Apple Account or Google Account. Eligibility for introductory offers is determined by the Store.
You can manage or cancel a subscription in your Apple Account subscription settings on iPhone, or in Google Play under Payments and subscriptions on Android. Deleting Countr does not cancel a subscription. Cancellation normally takes effect at the end of the current paid period. Purchases, billing, cancellations and refunds are processed under the Store's terms and refund procedures; Fabera does not receive your full payment-card details and cannot reverse a Store charge. You can request a refund from Apple at reportaproblem.apple.com, or from Google Play through your order history.
You are responsible for reviewing your trial and renewal date and cancelling in time. Unless required by law or provided by the Store, Fabera does not promise a separate notification before a trial converts or a subscription renews. Except where required by applicable law or granted by the Store, payments are non-refundable and no credit is given for a partially used period. We may change subscription features or future prices; any price change for an existing subscription is handled through the Store's notice or consent process.
8. Licence and acceptable use
For the App Store version of Countr, the licence to the application is granted and governed under Apple's Standard End User License Agreement ("Standard EULA"). For the Google Play version, Fabera grants you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the app on Android devices you own or control, subject to these Terms and the Google Play Terms of Service. The restrictions below supplement these licences. You must not, and must not help another person to:
- copy, sell, rent, sublicense, redistribute, commercially exploit, scrape or create derivative works from the Service, including its tracker catalogue, except where law expressly permits;
- reverse engineer, decompile, bypass access controls, defeat subscription checks, probe security or interfere with the Service;
- use the Service to monitor, locate or track another person without their knowledge and lawful consent;
- present Countr results as professional advice to others, or use the Service to provide legal, tax or immigration services;
- create, alter or submit false travel records or exports to deceive an authority or any other person;
- upload malware, unlawful or infringing material, or use the Service in breach of sanctions, export controls or other applicable law; or
- remove copyright, trademark or proprietary notices.
9. Intellectual property
The Service, software, interface, tracker catalogue, rule descriptions, guides, designs, the Countr name and logo, and other materials are owned by Fabera or its licensors and protected by intellectual-property laws. Except for the limited licence above, no right is granted to you. Your travel record and the files you create remain yours.
The app includes map boundary data, icons, a typeface and open-source software from third parties, used under their own licences (including CC BY 4.0, the Open Database License and the Open Government Licence v3.0). The credits and licences are listed in Credits and open data. Nothing in these Terms limits the rights those licences give you in that material.
If you voluntarily submit feedback, you grant Fabera a worldwide, perpetual, irrevocable, royalty-free licence to use it without restriction or compensation, without transferring ownership of your personal data. If you believe content in the Service infringes your rights, contact support@fabera.ai and identify the material, the right concerned and how we may contact you.
10. Third-party services and links
The Service depends on or links to Apple, Google, subscription-management, analytics, attribution, hosting and other third-party services, and to official websites of governments and authorities. Their products, content, availability and data practices are controlled by them and governed by their own terms. A link, citation or integration is not an endorsement. You are responsible for any internet, mobile-data, roaming or device charges. To the fullest extent permitted by law, Fabera is not responsible for third-party acts, omissions, outages, content or changes.
11. Service availability, updates and modifications
The Service may be interrupted, restricted, changed, suspended or discontinued for maintenance, security, legal, commercial, provider or other reasons. You may need to install updates to keep using it, and we may require a current supported version. We may decline to support jailbroken, modified or unsupported devices. Operating-system changes to photo, location, background or notification features may affect how the Service works. Subject to mandatory rights, we will not materially reduce the core paid access promised for a current paid period except where reasonably required for security, law, loss of a provider or service integrity; any remedy required by Apple or law remains available.
12. Events beyond our reasonable control
To the extent permitted by law, Fabera is not in breach of these Terms and is not liable for delay or failure caused by events beyond its reasonable control, including internet, telecommunications, cloud, power or App Store failures; operating-system changes; cyberattacks; natural disasters; epidemics; war; civil disorder; sanctions; or governmental, judicial or regulatory action, including sudden changes to entry, visa or tax rules. This does not remove mandatory consumer rights or any remedy required by Apple or law.
13. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL CONTENT, TRACKERS, DAY COUNTS, REMINDERS, EXPORTS AND THIRD-PARTY MATERIALS ARE PROVIDED "AS IS", "AS AVAILABLE" AND "WITH ALL FAULTS", AT YOUR SOLE RISK.
Fabera and its affiliates, directors, officers, employees, contractors, licensors and providers disclaim all express, implied and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, timeliness, reliability, availability, security and results. No statement by Fabera or its support staff creates a warranty unless contained in an express written amendment. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FABERA AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, OPPORTUNITY, DATA OR USE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE OR ANY OTHER THEORY, EVEN IF ADVISED THAT SUCH LOSS WAS POSSIBLE.
This includes, without limitation, loss arising from or relating to:
- an overstay, refused entry, entry ban, visa or permit refusal or cancellation, fine, penalty, deportation, or delayed or refused residence or citizenship application;
- a tax assessment, tax residence determination, interest, penalty, or cost of professional advice;
- reliance on any day count, limit date, auto-filled day, reminder, tracker, rule description, guide or calculator, or any error, omission or delay in them;
- inaccurate, missing or altered photo metadata or location data;
- lost, deleted or corrupted local data, or use of or inability to use the Service; and
- third-party services, links or security incidents, or unauthorised access to your device.
To the maximum extent permitted by law, the total aggregate liability of Fabera and the protected parties arising out of or relating to the Service or these Terms will not exceed the total subscription fees you actually paid for Countr during the 12 months immediately before the event giving rise to the claim. The limitations apply collectively to all protected parties and all claims.
Nothing in these Terms excludes or limits liability where that is prohibited, including for fraud, wilful misconduct, gross negligence where it cannot be excluded, death or personal injury caused by negligence, or mandatory consumer rights.
15. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Fabera and the protected parties from third-party claims, losses, penalties and reasonable legal costs arising from your unlawful use of the Service, breach of these Terms, infringement of another person's rights, use of the Service to track another person, or submission of false records. This does not require a consumer to indemnify Fabera for Fabera's own unlawful conduct. Fabera will give reasonable notice of a claim and may control its defence, with your reasonable cooperation.
16. Suspension and termination
You may stop using the Service at any time by deleting the app. Stopping use or deleting the app does not cancel an active subscription. We may suspend, restrict or terminate access, or discontinue the Service, where reasonably necessary because of a breach, suspected fraud, security risk, legal requirement, provider restriction or discontinuation. On termination, your licence ends. Provisions on advice limitations, accuracy, intellectual property, disclaimers, liability, indemnity and dispute resolution survive. Termination does not create a refund except where Apple or law requires one.
17. Governing law and dispute resolution
These Terms and any non-contractual obligations arising from them are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. Before filing a claim, you and Fabera agree to try in good faith to resolve the dispute by written notice to support@fabera.ai describing the issue and requested remedy, unless the law permits immediate recourse. If it is not resolved within 30 days, either party may pursue available remedies.
For disputes not subject to mandatory consumer jurisdiction, the courts and enforcement offices of Manisa, Türkiye have exclusive jurisdiction. If you are a consumer, nothing in these Terms removes rights or venues available under mandatory consumer-protection law, including Law No. 6502 on Consumer Protection and, where applicable, Consumer Arbitration Committees, Consumer Courts or courts where you live. Consumers in the EEA, United Kingdom, Switzerland or another protected jurisdiction keep the mandatory rights of the law where they habitually live.
18. Apple and Google Play terms
Apple's Standard EULA applies to the licence for the App Store version of Countr. These Terms are supplemental service terms; they are not a Custom EULA. If they conflict with Apple's Usage Rules or Standard EULA on an app-licence matter, Apple's terms control to the extent of the conflict.
These Terms are between you and Fabera, not Apple. Fabera, not Apple, is solely responsible for the Service and its content, and for any maintenance and support required under these Terms or law; Apple has no obligation to provide maintenance or support. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Fabera, not Apple, is responsible for addressing claims relating to the app or your possession or use of it, including product-liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer-protection, privacy or similar law, and for investigating, defending and settling any third-party intellectual-property claim.
You represent that you are not located in a country subject to a United States Government embargo or designated as a "terrorist supporting" country, and that you are not on any United States Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.
For the Google Play version of Countr, these Terms are between you and Fabera, not Google. Google is not responsible for the Service or its content and has no obligation to provide maintenance or support for it. Your use of Google Play, and purchases made through it, are also governed by the Google Play Terms of Service. If these Terms conflict with them on a matter Google Play controls, the Google Play terms control to the extent of the conflict.
19. Changes to these Terms
We may update these Terms to reflect changes in the Service, providers, law, security or business. The "Last updated" date identifies the current version. Where required, we will give reasonable notice of material changes through an in-app message, this website, the App Store or Google Play listing, or another reasonable channel. Changes apply prospectively and do not remove rights that accrued before they took effect. If you do not agree, stop using the Service and cancel any subscription before its next renewal.
20. General provisions and contact
If any provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent and the rest remains effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a reorganisation, merger, acquisition, financing or sale of assets, subject to law. These Terms, the purchase disclosures shown at checkout and, for the app licence only, Apple's Standard EULA are the whole agreement for the Service. Except for Apple as stated in Section 18, these Terms create no third-party beneficiary rights. These Terms are written in English; where we provide a translation for convenience, the English version governs in case of conflict, to the extent permitted by law.
