Residency rule, Brazil

Brazil Citizenship — Time Away in 4 Years

Summary

For ordinary naturalisation in Brazil you need four years of residence just before you apply. Trips abroad in those four years do not block the application when they add up to 12 months or less. If your trips add up to more than 12 months, the four years are not complete. The rule is in article 233 of Decree 9.199 of 2017. You apply at the Federal Police, and the Ministry of Justice and Public Security decides. A second limit applies to each single year.

The rule

Article 65 of the Migration Law, Law 13.445 of 2017, gives four conditions for ordinary naturalisation: civil capacity under Brazilian law, residence in Brazil for at least four years, the ability to communicate in Portuguese, and no criminal conviction, or rehabilitation. Article 233 of Decree 9.199 of 2017 repeats them and adds the detail on residence.

Paragraph 1 of article 233 says the four years must come immediately before the application. Paragraph 2 says that, in counting them, sporadic trips abroad whose total length is not more than 12 months do not prevent naturalisation. Sporadic means occasional: trips, not a move away. The same article says that owning property in Brazil is not enough proof, you must show that you really lived there.

Only some residence counts. Article 221 of the decree says the periods counted are those in which you lived in Brazil with residence for an indefinite period. Time on a visitor visa or a short temporary permit is not counted towards the four years.

A ministry rule adds a second limit. Article 51 of Portaria 623 of 2020 says that trips count as sporadic when they add up to less than 90 days per year, inside the maximum of 12 months. That yearly limit has its own tracker, Brazil Citizenship — Time Away in One Year. To be safe you need to respect both limits.

Why it exists

Naturalisation is for people who have made their life in Brazil. Four years of real residence shows a lasting link to the country. The state accepts that residents travel for work, family and holidays, so it allows a total of 12 months abroad, but it does not want to give citizenship to a person who held a permit and lived somewhere else.

Counting the days

You count the time you spent outside Brazil during the four years that end on the day you apply. All trips are added together.

  1. Choose the day you plan to apply and go back four years from it.
  2. List every trip abroad inside those four years, with the day you left and the day you returned.
  3. Count the days of each trip and add them up.
  4. Compare the total with 12 months. At or under 12 months, the trips do not block the application.
  5. If the total is over 12 months, move your application date later until the last four years hold 12 months or less abroad.
  6. Check each single year too, because the ministry treats trips as sporadic only when they add up to less than 90 days per year.
How Countr counts it. Countr adds up your days outside Brazil over the 48 months that end today, as if you applied today, and shows the total against 365 days. Twelve months is counted as 365 days so that the card warns early, never late. The day you leave and the day you return are not counted as days away, because you were in Brazil for part of them. Countr only counts days it can see: if your photos have long gaps, your real time away can be higher than the app shows. With a Brazilian child or spouse you need only one year of residence, so this card can be stricter than your case.

Examples

Regular work trips, under the limit

Chen got indefinite residence in 2021 and plans to apply on 1 October 2026. He looks at 1 October 2022 to 30 September 2026. In each of the four years he was abroad for 60 days on work trips. The total is 240 days, which is under 12 months, and each year is under 90 days. His trips do not block the application.

A master's degree abroad

Sofia has lived in Brazil with indefinite residence since 2020. From August 2023 to September 2024 she studied in Spain for 14 months. If she applies in October 2026, the last four years contain more than 12 months abroad, so her four years of residence are not complete. She needs to wait until the long absence falls outside the four years before her application date.

Under 12 months in total, but one heavy year

Ahmed was abroad for 30 days in each of three years and for 150 days in the fourth year. His total is 240 days, well under 12 months. But 150 days in one year is more than the ministry's line of less than 90 days per year, so the trips of that year may not count as sporadic. He passes this limit and fails the sister limit, and both matter.

Exceptions

Common misconceptions

“Any four years of residence in my life are enough.”
No. The decree says the four years must come immediately before the application. Old years of residence followed by a long time abroad do not count.
“I must not leave Brazil at all during the four years.”
You can travel. Occasional trips that add up to 12 months or less do not stop the application, and the ministry looks for less than 90 days abroad per year.
“My years in Brazil on a student or work visa count towards the four years.”
Article 221 of the decree counts only the periods in which you had residence for an indefinite period. Earlier time on other permits is not counted.
“Owning a home in Brazil proves my residence.”
The decree says the opposite. Owning or holding property is not enough proof, and you must show that you really lived in Brazil.

Questions and answers

How many days can I be outside Brazil before I apply for citizenship?

Up to 12 months in total during the four years before you apply, in occasional trips. The ministry also expects less than 90 days abroad in each year.

Do the days I fly out and fly back count as days abroad?

The decree does not say how to count travel days. Countr does not count them as days away, because you were in Brazil for part of each one. If you are close to the limit, count them as days away to be safe.

What happens if my trips add up to more than 12 months?

The four years of residence are not complete on that date, so the application can be refused. You can apply later, when the four years before your new application date contain 12 months or less abroad.

Is the limit different if I am married to a Brazilian?

Yes. With a Brazilian spouse, partner or child, you need one year of residence, not four. The limits on trips then apply to that shorter period.

Where do I apply for Brazilian naturalisation?

You present the request at a Federal Police unit, addressed to the Ministry of Justice and Public Security, which decides. The ministry checks official databases to confirm your residence and your trips.
